Office of the Children’s Lawyer protect minor children under the age of 18 years old in legal matters. In an estate where one of the unmarried parents of a minor child dies without a will and that person owns property. The property is mortgaged and the deceases estate defaults on the mortgage payments and there is a foreclosure on the property by the mortgagee because the deceases estate has gone into default. The mortgagee starts a court action for foreclosure the mortgagee has to serve the Office of the Children’s Lawyer. This is to protect any interest the child may have in the equity of the property, this is a progressive move by Ontario to protect the right of minor children.
